Former FedEx driver sentenced for stealing guns from packages

A former FedEx delivery driver was sentenced to six days in prison for stealing and selling guns from packages he was supposed to deliver, according to the U.S. District Attorney’s Office for Massachusetts. 

Frank P. O’Toole, 40, was sentenced Feb. 2 to time served and three years of supervised release, during which he must complete 250 hours of community service, a press release published Tuesday said. O’Toole pleaded guilty on two counts of possession or sale of a stolen firearm in June. 

While O’Toole worked as a FedEx delivery truck driver at a facility in Middleborough between October 2021 and June 2022, he stole three packages that were sent from out-of-state, prosecutors said. Each package contained a firearm — two rifles and a shotgun — which were supposed to be delivered to a “Federal Firearms Licensee,” the District Attorney’s office said.

O’Toole then sold the firearms to an undercover agent on Aug. 9, 2022 and Aug. 12, 2022, according to officials. 

The federal government recommended a sentence of 10 months in prison, the U.S. Attorney’s Office said.
